Allgemeine Geschäftsbedingungen
Jeder Vertrag und Kontakt mit den Auftraggeber*innen, erfolgt ausschließlich direkt über Josephine Winter (nachfolgend “JW”).
Die folgenden allgemeinen Geschäftsbedingungen sind für den Auftraggeber und Josephine Winter bindend.
Jede Auftragserteilung zwischen dem Künstler und Auftraggeber ist bindend.
Die Tagesgage wird mit Josephine Winter direkt verhandelt und verläuft sich, wenn nicht anders besprochen auf 10 Std/Tag.
Die Vergütung bei Überstunden bedarf einer vorherigen und direkten Absprache.
Generell gilt:
1.und 2. Stunde —10% vom Tagessatz plus 25%
3. und 4. Stunde 10% vom Tagessatz plus 50%
5. Stunde 10% vom Tagessatz plus 100%
ab 6. Stunde doppelter Tagessatz.
Josephine Winter behält sich das Recht vor, eine angemessene Ausfallgage bei kurzfristiger Absage zu berechnen.
Der Mindestbetrag liegt bei 50% des vereinbarten Tagessatzes und kann bis zu 100% des vereinbarten Honorars betragen.
Zusätzlich werden durch den Künstler bereits gezahlte Reisekosten zu 100% in Rechnung gestellt.
Reisekosten und Reisetage sind nach zeitlichem Aufwand direkt mit JW zu verhandeln.
Generell gilt:
Reisedauer bis 5 Stunden 0,5 Tage der vereinbarten Tagesgage. Ab 5 Stunden 100% Tagessatz.
Im Voraus erstellte und zur Verfügung gestellte Arbeitsproben von JW an den Auftraggeber dürfen nicht vervielfältigt oder an Dritte weitergereicht werden.
Das Einholen von Veröffentlichungsrechten bei Fremdfirmen für jegliche zur Publikation vorgesehene Markenprodukte obliegt dem Auftraggeber.
JW ist berechtigt die Fotografien und Filme, die unter ihrer Mitwirkung erstellt wurden, zur Eigenwerbung digital, analog sowie im Internet auf den sozialen Medien zu nutzen.
Terms & Conditions
Every contract and contact with the client takes place exclusively directly through Josephine Winter (hereinafter referred to as “JW”).
The following general terms and conditions are binding for the client and Josephine Winter.
Any order between the artist and the client is binding.
The daily fee is negotiated directly with Josephine Winter and, unless otherwise agreed, runs to 10 hours/day.
Remuneration for overtime must be agreed in advance and directly.
In general, the following applies:
1st and 2nd hour — 10% of the daily rate plus 25%
3rd and 4th hour 10% of the daily rate plus 50%
5th hour 10% of the daily rate plus 100%
from the 6th hour double daily rate.
Josephine Winter reserves the right to charge a reasonable cancellation fee in the event of a short-term cancellation.
The minimum amount is 50% of the agreed daily rate and can be up to 100% of the agreed fee.
In addition, 100% of travel expenses already paid by the artist will be charged.
Travel expenses and travel days are to be negotiated directly with JW according to the time spent.
In general, the following applies:
Travel duration up to 5 hours 0.5 days of the agreed daily fee. From 5 hours 100% daily rate.
Work samples prepared and made available in advance by JW to the Client may not be copied or passed on to third parties.
It is the responsibility of the client to obtain publication rights from external companies for any branded products intended for publication.
JW is entitled to use the photographs and films created with its participation for its own promotion digitally, analogue and on the Internet on social media.
